Electronic Notice of Privacy Practices for Protected Health Information |
Procedure |
Policy: Community Care provides clients with adequate notice of the uses and disclosures of protected health information that may be made. Community Care also provides adequate notice of the client’s rights and Community Care’s legal duties with respect to protected health information. The notice must contain the elements as set forth in Community Care Policy and Procedure. Community Care makes the notice available on request to any client or person. If the Community Care has a direct treatment relationship with an individual, the notice must be provided no later than the date of the first service delivery. In an emergency situation, provision of the notice must be made as soon as practicably after the emergency treatment situation has ended. Community Care will make a good faith effort to obtain written acknowledgement by the client of receipt of the notice. If written acknowledgement is not obtained, Community Care will document its efforts to obtain the acknowledgement and the reason why the acknowledgement was not obtained. The notice will be available at the service delivery site, will be available for clients to take with them, and will be posted in a clear and prominent location where it is reasonable to expect individuals seeking service to be able to read the notice.
