Policy:  Community Care will verify the identity and authority of a person who is requesting protected health information if the identity and authority is unknown to them. If the unknown person is a public official, Community Care may rely on the following to verify identity: if in person, an agency identification badge, other official credentials, or other proof of government status; if the request is in writing, it must be on appropriate government letterhead, or a document indicating that a person is acting on behalf of a public official. To verify authority of the person, Community Care may rely on a written statement of the legal authority under which the information is requested or, if that is impracticable, an oral statement of the legal authority or if the request is made pursuant to legal process, warrant, subpoena, order, or other legal process issued by a grand jury or a judicial or administrative tribunal.
